Guest WiFi Terms of Use

Indian Wells Resort Hotel (“Hotel”, “we”, “us”, or “our”) provides Guest WiFi access, including both Complimentary WiFi and Premium WiFi, as an amenity for registered guests and other authorized users (“you”). By checking the box on the Guest WiFi login page and connecting to this network, you agree to the following Terms of Use. These terms apply to all tiers of the Guest WiFi service.

1. Acceptable Use

You agree not to use the Guest WiFi service (including Complimentary WiFi and Premium WiFi) to:

• Violate any applicable local, state, federal, or international law or regulation;
• Transmit, distribute, or store any content that is unlawful, harmful, abusive, or otherwise objectionable;
• Transmit unsolicited bulk email, spam, or other unauthorized advertising;
• Attempt to gain unauthorized access to any system, network, device, or account;
• Interfere with, disrupt, or degrade the operation or security of the WiFi service or any connected systems.

2. Security and Privacy

This Guest WiFi service is provided over a shared wireless network. You are responsible for using appropriate security measures on your devices (such as firewalls, antivirus software, and encryption). We may collect limited technical information, such as device identifiers, MAC addresses, and connection times, for purposes of operating, securing, and improving the network, and for applying the appropriate Complimentary or Premium service profile to your device. 3. Service Levels and Performance

The Guest WiFi service offers two connection options:

• Complimentary WiFi: A general-access connection that may be subject to bandwidth limitations, rate shaping, or other controls designed to provide a fair and reliable experience for all guests.
• Premium WiFi: An enhanced connection available to guests with a valid access code, typically offering higher bandwidth or fewer restrictions than the Complimentary WiFi tier.

While we strive to provide a reliable and high-quality connection for both tiers, we do not guarantee any particular speed, bandwidth, uptime, or performance level. Actual performance may vary based on usage, location, device capability, network conditions, and other factors. We may manage, prioritize, or limit traffic on either tier to maintain overall service quality and protect the network.

4. Monitoring and Enforcement

We reserve the right, but are not obligated, to monitor network activity to ensure compliance with these Terms of Use and to protect the security and integrity of the service. We may suspend, restrict, or terminate your access to the Guest WiFi service (Complimentary or Premium) at any time, without notice, if we reasonably believe you have violated these terms or are using the service in a way that could harm other users or the Hotel.

5. Limitation of Liability

To the maximum extent permitted by law, the Guest WiFi service (including Complimentary and Premium tiers) is provided “as is” and “as available” without warranties of any kind, either express or implied. The Hotel and its service providers shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in any way connected with your use of, or inability to use, this WiFi service.

6. Changes to These Terms

We may update these Terms of Use from time to time. The version posted at the time you connect will govern your use of the service during that session. We encourage you to review the terms periodically.
